IMPORTANT – PLEASE READ CAREFULLY. These Terms and Conditions (“Terms”) constitute a legally binding agreement between you and DoubtFix. By sending a message to DoubtFix on WhatsApp, registering as a user, or accessing any part of our service, you confirm that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree, do not use DoubtFix.

1. Definitions

In these Terms, the following words shall have the meanings assigned to them below:

“DoubtFix” / “we” / “us” / “our” / “Company” refers to the DoubtFix platform and its owner/operator.
“Service” means DoubtFix’s AI-powered academic doubt-resolution service, delivered through WhatsApp and any associated platforms, tools, or content produced by DoubtFix.
“User” / “you” / “your” / “Student” refers to any individual who registers, accesses, or uses DoubtFix in any capacity.
“Content” means all text, images, diagrams, answers, tips, study materials, and any other material generated or provided by DoubtFix through its Service.
“AI Response” means any answer, explanation, or content generated by the Google Gemini AI model on behalf of DoubtFix in response to a User’s doubt query.
“Subscription” means a paid plan granting the User access to DoubtFix’s Service for a defined period.
“WhatsApp” refers to the WhatsApp messaging platform owned by Meta Platforms, Inc.
“Board Curriculum” refers to the SEBA (Secondary Education Board of Assam) Class 10 syllabus and the AHSEC (Assam Higher Secondary Education Council) Class 11 and Class 12 syllabi.

2. Description of Service

DoubtFix is an AI-powered educational assistance platform that provides 24×7 academic doubt-resolution services through WhatsApp to students enrolled in SEBA (Class 10) and AHSEC (Class 11–12) board curricula in Assam, India. DoubtFix uses Google Gemini AI to generate responses and delivers them in a natural mix of Romanised Assamese and English.

DoubtFix is a supplementary educational tool and is intended to assist students in understanding concepts, solving problems, and preparing for board examinations. It is not a replacement for school education, classroom instruction, or qualified human tutors.

DoubtFix reserves the right, at its sole discretion, to:

Modify, add, suspend, or remove any feature of the Service at any time without prior notice.
Temporarily suspend the Service for maintenance, updates, technical issues, or any other operational reason.
Limit the number of doubt queries per session or per day, or introduce fair-use policies at any time.
Discontinue the Service permanently, with reasonable notice to active paying subscribers.

3. Eligibility

DoubtFix is available to any student who:

Owns or has access to a smartphone with an active WhatsApp account.
Provides a valid Indian mobile phone number.
Is currently enrolled in or preparing for SEBA Class 10 or AHSEC Class 11–12 examinations (other students may also use the service but optimal content alignment is for these boards).

Users under the age of 18 may use DoubtFix with the consent of their parent or legal guardian. By registering, the User (or their parent/guardian, if a minor) confirms eligibility and the accuracy of information provided during onboarding.

DoubtFix reserves the right to reject, suspend, or terminate any account that does not meet eligibility requirements or provides false information during registration, without any obligation to refund any amounts paid.

4. Subscription, Fees & Payment

4.1 Free Trial

DoubtFix may offer a limited free trial period at its sole discretion. The scope, duration, and terms of the free trial may be modified or withdrawn by DoubtFix at any time without notice.

4.2 Paid Subscription

After the trial period (if any), access to DoubtFix requires a paid subscription. Subscription plans, pricing, and features are published on the DoubtFix website and/or communicated via WhatsApp. DoubtFix reserves the right to change subscription plans, pricing, or the features included in any plan at any time. Changes will be communicated with reasonable advance notice to active subscribers.

4.3 Payment

Payment for DoubtFix subscriptions is accepted through the payment methods specified at the time of purchase. All payments are in Indian Rupees (INR). You are solely responsible for ensuring timely payment. DoubtFix is not responsible for any bank charges, transaction failures, or errors caused by your payment provider.

4.4 Refund Policy

All subscription fees paid to DoubtFix are non-refundable, except where required by applicable Indian consumer protection law. DoubtFix does not offer pro-rated refunds for partial use of a subscription period, cancellations, or dissatisfaction with AI-generated responses. If you believe an exception applies to your situation, you may submit a written request to our support contact; DoubtFix will evaluate it at its sole discretion, and its decision shall be final.

4.5 Taxes

All applicable taxes (including GST) shall be borne by the User. DoubtFix will provide tax invoices as required by Indian law.

5. Acceptable Use Policy

You agree to use DoubtFix only for its intended educational purpose and only in a manner consistent with these Terms and applicable law. You agree NOT to:

Submit content that is abusive, harassing, threatening, obscene, defamatory, hateful, or otherwise inappropriate.
Use DoubtFix to seek assistance with any activity that is illegal, fraudulent, or harmful to others.
Attempt to bypass, disable, or interfere with the DoubtFix automation system, WhatsApp integration, or any underlying technology.
Share, resell, sublicense, or distribute DoubtFix responses, Content, or access to any third party for commercial purposes without express written permission from DoubtFix.
Submit false information during onboarding or misrepresent your identity or academic details.
Use automated bots, scripts, or tools to interact with DoubtFix other than through normal WhatsApp usage.
Attempt to reverse-engineer, copy, reproduce, or replicate DoubtFix’s workflows, system prompts, or proprietary AI configurations.
Use DoubtFix for any purpose other than legitimate academic doubt-resolution related to your own studies.
Engage in academic dishonesty, including but not limited to submitting DoubtFix answers as your own original work in examinations or assessments where AI assistance is prohibited by your institution.

DoubtFix reserves the right to immediately suspend or terminate the account of any User found to be in violation of this Acceptable Use Policy, without refund and without prior notice.

6. AI-Generated Content Disclaimer

AI Responses are generated by Google Gemini, a large language model, and are provided “as is.” While DoubtFix has engineered its system to align with SEBA and AHSEC board curricula, DoubtFix makes no representation, warranty, or guarantee that any AI Response is:

Completely accurate, current, or free from error.
Fully aligned with the specific marking scheme or model answers of any particular board examination year.
A guaranteed pathway to academic success or specific examination scores.

Students are strongly advised to cross-verify important answers with their textbooks, teachers, or other authoritative educational sources before relying on them for examination preparation. DoubtFix shall not be held liable for any academic outcome, loss of marks, examination failure, or any other consequence resulting from reliance on AI-generated content.

DoubtFix does not guarantee any specific academic results, grades, scores, or pass outcomes as a result of using its service. Educational outcomes depend on many factors including student effort, classroom instruction, and individual aptitude, all of which are entirely outside DoubtFix’s control.

7. Intellectual Property Rights

All intellectual property in and relating to DoubtFix, including but not limited to the brand name “DoubtFix,” logo, system design, AI prompt architecture, automation workflows, response formats, image card designs, database architecture, website content, and all Content generated by DoubtFix is and remains the exclusive property of DoubtFix and its owner.

DoubtFix grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service solely for your own personal, non-commercial educational purposes during the period of your active subscription.

You may not, without prior written consent of DoubtFix:

Copy, reproduce, republish, upload, post, transmit, or distribute DoubtFix Content in any form or medium.
Use DoubtFix’s brand name, logo, or any proprietary marks for any commercial purpose.
Create derivative works based on DoubtFix’s Content, workflows, or system design.
Use DoubtFix’s AI response architecture or system prompts to build a competing or similar product or service.

Any content or material you submit to DoubtFix (your doubt queries, messages) remains yours. However, by submitting such content you grant DoubtFix a worldwide, royalty-free, perpetual, irrevocable licence to use, process, and store such content for the purposes of providing the Service, improving AI model quality, and fulfilling our legal obligations, subject to our Privacy Policy.

8. Service Availability & Force Majeure

DoubtFix aims to provide a reliable 24×7 service but does not guarantee uninterrupted or error-free availability. The Service is dependent on third-party infrastructure including WhatsApp, AiSensy, Make.com, Airtable, Google Gemini, and Vercel. DoubtFix is not responsible for any disruptions, delays, or failures caused by these third-party platforms.

DoubtFix shall not be liable for any failure or delay in performing its obligations under these Terms that is caused by events beyond its reasonable control, including but not limited to:

Acts of God, natural disasters, floods, or earthquakes.
Power failures, internet outages, or network disruptions.
Government actions, lockdowns, or regulatory orders.
Failures, policy changes, or outages of third-party platforms (WhatsApp, Google, Meta, Airtable, Make.com, AiSensy, Vercel).
Cybersecurity attacks, data breaches, or other malicious technical incidents.

In such circumstances, DoubtFix will use reasonable efforts to restore the Service as quickly as possible but shall not be obligated to provide any compensation, refund, or service credit for such downtime.

9. Limitation of Liability

To the fullest extent permitted by applicable Indian law, DoubtFix, its owner, partners, employees, agents, and affiliates shall not be liable for:

Any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Service.
Any loss of data, loss of profits, loss of academic opportunity, or examination failure, whether arising in contract, tort, negligence, or otherwise.
The accuracy, completeness, or suitability of any AI-generated Content for any specific purpose.
Any act, omission, or policy of WhatsApp, Meta, Google, AiSensy, Make.com, Airtable, or Vercel.
Any unauthorised access to or alteration of your data resulting from a breach of third-party systems.
Any content submitted by other users of the Service.

In any event, the maximum aggregate liability of DoubtFix to you for any cause of action, regardless of the form, shall not exceed the total amount actually paid by you to DoubtFix in the one (1) calendar month immediately preceding the event giving rise to the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless DoubtFix and its owner, employees, agents, and partners from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:

Your violation of these Terms or any applicable law or regulation.
Your misuse of the Service or any Content obtained through the Service.
Any false, misleading, or inaccurate information you provided during registration or use of the Service.
Any dispute between you and a third party arising from your use of DoubtFix.
Any academic or institutional disciplinary action arising from your use of AI-generated content in a context where such use is prohibited.

11. Account Suspension & Termination

DoubtFix reserves the right to suspend, restrict, or permanently terminate your access to the Service at its sole discretion, with or without cause, with or without prior notice, in situations including but not limited to:

Violation of these Terms or the Acceptable Use Policy.
Non-payment or failure to renew your subscription.
Fraudulent, abusive, or harassing behaviour towards DoubtFix or its systems.
Providing materially false information during registration.
If required by applicable law or court order.
If DoubtFix reasonably believes that continued access may harm the Service, other Users, or DoubtFix itself.

Upon termination for cause, no refund shall be issued. Upon termination of your subscription for non-renewal, your access will continue until the end of the current paid billing period.

You may terminate your own subscription at any time by sending a cancellation request to DoubtFix. Cancellation takes effect at the end of your current billing period. No refunds are issued for unused days within a billing period.

12. Third-Party Links & Platforms

DoubtFix operates through WhatsApp, a platform owned and operated by Meta Platforms, Inc. Your use of WhatsApp is subject to WhatsApp’s own Terms of Service and Privacy Policy, which are separate from and independent of these Terms. DoubtFix has no control over WhatsApp’s policies, features, availability, or data practices.

DoubtFix may share links to external educational resources or websites. These are provided for convenience only. DoubtFix does not endorse, control, or take any responsibility for the content, accuracy, or data practices of any third-party website or resource.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE INDIAN LAW, DOUBTFIX EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO:

Implied warranties of merchantability or fitness for a particular purpose.
Warranties that the Service will meet your specific requirements or expectations.
Warranties that the Service will be uninterrupted, timely, secure, or error-free.
Warranties regarding the accuracy, reliability, completeness, or quality of any AI-generated Content.
Warranties that defects in the Service will be corrected within any specific timeframe.

14. Governing Law & Dispute Resolution

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Informal Resolution: Before initiating any formal legal proceeding, you agree to contact DoubtFix and attempt to resolve the dispute informally. DoubtFix will endeavour to respond to your concern within 30 days.

Jurisdiction: If informal resolution is not achieved within 30 days, both parties agree that any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts located in Guwahati, Assam, India. You irrevocably submit to the exclusive jurisdiction of these courts and waive any objection to proceedings in such courts on grounds of inconvenient forum or otherwise.

15. Modifications to Terms

DoubtFix reserves the right to modify these Terms at any time, at its sole discretion. The updated Terms will be published on the DoubtFix website with a revised “Last Updated” date. For material changes, DoubtFix will make reasonable efforts to notify active paying subscribers via WhatsApp.

Your continued use of the Service after the effective date of any revised Terms constitutes your binding acceptance of those changes. If you disagree with any revised Terms, your sole remedy is to discontinue use of the Service and, if applicable, cancel your subscription.

16. Severability & Entire Agreement

If any provision of these Terms is found by a competent court to be invalid, unlawful, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed from the Terms. The remaining provisions shall continue in full force and effect and shall not be affected by such invalidity or unenforceability.

These Terms, together with the DoubtFix Privacy Policy, constitute the entire agreement between you and DoubtFix with respect to the Service and supersede all prior agreements, representations, and understandings, whether oral or written, relating to the same subject matter. No waiver of any provision of these Terms shall be effective unless in writing and signed by an authorised representative of DoubtFix.
